These Terms and Conditions ("Terms") govern your use of Makelab Inc.'s ("Makelab," "we," "us," or "our") website, services, and SMS messaging program. By using our website, requesting a quote, placing an order, or opting in to our SMS program, you agree to these Terms.

1. Services

Makelab provides 3D printing manufacturing services to businesses and individuals from our facility in Brooklyn, New York. Quotes, lead times, and pricing are subject to confirmation and may change based on file review, materials, capacity, and shipping requirements.

2. Quotes and Orders

Quotes are valid for 14 days from the date issued unless otherwise stated. Orders are confirmed upon written acceptance and receipt of payment or purchase order in accordance with the agreed payment terms. Production lead times begin once payment and final files are received and approved.

3. Payment

Payment terms are stated on each quote or invoice. We accept payment by credit card, ACH, wire transfer, and approved net terms. Production lead times begin once payment or an approved purchase order is received.

Late payments and card-on-file authorization. Invoices not paid by the due date are past due and may incur a late fee of 1.5% per month (or the maximum rate permitted by law, whichever is lower), assessed on the unpaid balance from the original due date. By providing a credit or debit card to Makelab — whether to pay an invoice, fund a deposit, or as a card on file — you authorize Makelab to charge that card, and any other card you have previously provided to us, for any past-due balance, late fees, and any outstanding amount owed under your account, without further notice. You also authorize Makelab to retain card information on file for this purpose. You may revoke this authorization at any time by notifying Makelab in writing, except with respect to balances that are already past due at the time of revocation.

Makelab may suspend production, hold completed parts, withhold shipment, and decline new orders while any balance remains past due. You agree to pay all reasonable costs of collection, including attorneys’ fees and court costs.

4. Intellectual Property

You retain all rights to the 3D files, drawings, and project information you submit. You grant Makelab a limited license to use these materials solely to fulfill your order. Makelab retains all rights to its proprietary processes, materials, and content on our website.

5. Warranty and Returns

Parts are warranted to conform to the specifications in your accepted quote. Defects must be reported within 30 days of delivery. Makelab's sole obligation is, at its option, to repair, replace, or refund the affected parts.

6. Shipping, Lost Packages, and Damage in Transit

Every shipment is automatically insured for the full order value at no additional cost to the customer. Shipping insurance is included on every order; customers do not opt in or pay separately for this coverage. If a package is lost in transit, marked delivered but not received, or arrives damaged, please report it through the support chat at help.makelab.com. Makelab will file the carrier claim on the customer's behalf — customers do not need to contact UPS or the carrier directly.

Upon notification of a shipping issue, Makelab will reprint and reship the affected parts at no additional charge. Refunds are not offered for lost or damaged shipments — Makelab's remedy is to reprint and reship. Shipping damage must be reported within 7 days of delivery, with photographs of both the damaged parts and the original packaging. Lost-package reports must be made within 30 days of the ship date to remain eligible for claim recovery.

This shipping protection applies to all orders shipped via Makelab's carrier accounts. It does not apply to orders where the customer provides their own shipping label or carrier account number; in those cases, the customer is responsible for filing any claims with their selected carrier.

7. Limitation of Liability

To the maximum extent permitted by law, Makelab's total liability for any claim arising from the services or these Terms is limited to the amount you paid for the affected order. Makelab is not liable for indirect, incidental, special, or consequential damages.

8. Governing Law

These Terms are governed by the laws of the State of New York, without regard to its conflict of laws rules. Disputes will be resolved in the state or federal courts located in Brooklyn, New York.

9. Privacy

Your use of our services is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.


Makelab SMS / Text Messaging Program Terms

These SMS Program Terms ("SMS Terms") apply to the Makelab SMS messaging program ("the Makelab program") and form part of the Terms and Conditions above. By opting in to the Makelab program, you agree to these SMS Terms.

1. Program Description

The Makelab program is a transactional and conversational SMS program. Customers and prospects who explicitly opt in receive SMS text messages from Makelab about order status and production updates, quote notifications, delivery, shipping, and pickup confirmations, and one-to-one replies to inquiries and support requests. The Makelab program is transactional and conversational only. We do not send promotional or marketing SMS messages.

2. How to Opt In

You may opt in to the Makelab program by:

  1. Submitting our intake form at https://www.makelab.com/intake and ticking the standalone, unchecked-by-default SMS consent checkbox; or
  2. Submitting our SMS opt-in form at https://www.makelab.com/sms-opt-in and ticking the standalone, unchecked-by-default SMS consent checkbox.

The consent checkbox is presented separately from any other agreement and the form cannot be submitted unless you tick it. The verbatim consent language presented on both forms reads:

"I agree to receive SMS text messages from Makelab at the phone number provided about my order status, quotes, project updates, delivery notifications, and responses to my inquiry. Message frequency varies. Message and data rates may apply. Reply STOP to opt out, HELP for help. SMS consent is not shared with third parties. See our SMS Policy and Privacy Policy."

3. How to Cancel — Opt Out

You can cancel the SMS service at any time. Just text "STOP" to the Makelab number. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

Additional recognized opt-out keywords: STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT, OPTOUT, REVOKE.

Opt-out confirmation auto-reply:

You have successfully been unsubscribed. You will not receive any more messages from this number. Reply START to resubscribe.

4. How to Get Help

If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at (888) 355-1570.

5. Carriers

Carriers are not liable for delayed or undelivered messages.

Supported carriers include AT&T, Verizon Wireless, T-Mobile, Sprint, Boost, U.S. Cellular, MetroPCS, Virgin Mobile, and Cricket.

6. Cost and Message Frequency

Makelab does not charge a fee to receive SMS messages. As always, message and data rates may apply for any messages sent to you from us and to us from you. You will receive between 1 and 10 messages per active order or quote. Message frequency varies. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

7. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) and the customary user of the mobile number you provide to opt in to the Makelab program.

8. Privacy and Data Sharing

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Phone numbers collected through our opt-in forms are used solely to send the transactional notifications described above. Makelab does not buy, rent, sell, or share phone numbers, SMS opt-in data, or consent with any third party for any purpose other than operating the Makelab program. Phone numbers are shared only with our SMS delivery provider strictly for the purpose of delivering messages you have consented to receive.

9. Changes to These SMS Terms

Makelab may update these SMS Terms from time to time. The "Last updated" date above reflects the most recent revision. Continued participation in the Makelab program after changes are posted constitutes acceptance of the revised SMS Terms.
