Terms & Conditions

These Terms and Conditions (“Agreement”) govern all services provided by Makelab, Inc (“Makelab,” “we,” or “us”) to the customer (“Client,” “you,” or “your”) and shall apply to all orders, deliverables, consultations, and transactions unless otherwise agreed in writing by both parties. By engaging Makelab’s services, submitting files, or making payment, you acknowledge and agree to be bound by the following terms.

1. Business Day Cutoff Times

All service requests, order submissions, and file uploads received by Makelab prior to 3:30 PM Eastern Standard Time (EST) on a business day will be processed and reviewed within that same business day, subject to operational capacity. Any order, file, or inquiry received after 3:30 PM EST, on weekends, or on a U.S. federal holiday will be deemed received on the following business day and processed accordingly.

2. File Changes and Order Modifications

Once an order has been scheduled for dispatch, the dispatch method (e.g., pickup, delivery, or shipping) may not be changed on the day of dispatch under any circumstances. This policy is strictly enforced to preserve operational flow and avoid disruption to fulfillment timelines. Any request to change the dispatch method must be submitted at least one (1) full business day in advance of the scheduled dispatch date and confirmed in writing by a Makelab representative.

Once an order has been submitted and confirmed, Makelab does not permit substitution or modification of the original 3D CAD file (commonly referred to as a “file trade-in”) unless expressly reviewed and approved by a Makelab representative. Approval of such modifications is granted solely at Makelab’s discretion and is contingent upon evaluation of the revised file’s printability, impact on production workflow, and any applicable change in cost.

Requests to alter order details, including but not limited to file updates, technology changes, or material substitutions, must be submitted via email within six (6) hours of the original order timestamp. Change requests submitted beyond this window will not be honored under the original order and may require a new order to be placed.

In the case of confirmed orders, any changes must be communicated within a two (2) hour period following issuance of the confirmation. After this two-hour window, the order enters processing and is no longer eligible for modification or cancellation without incurring applicable fees or delays.

Where a reprint is authorized by Makelab, the reprinted part must correspond exactly to the original CAD file submitted. Any updates, alterations, or new iterations of a file will require submission as a separate and new order, subject to new pricing and lead time review.

For orders placed through the Makelab Instant Quoter, all CAD files are processed and printed in the form received, without manual verification of scale, accuracy, or completeness. Makelab disclaims all responsibility for errors resulting from improperly scaled, dimensioned, or oriented CAD files submitted via this system. Clients are solely responsible for ensuring the dimensional integrity of submitted files prior to order placement.

For manually quoted orders, Clients shall verify all critical dimensions, units, materials, and specifications included in the PDF quotation and accompanying email at the time of review. Final approval of a quote constitutes acceptance of those specifications in full.

3. Manufacturability Assessment

Upon receipt of an order and its corresponding file(s), Makelab will perform an internal manufacturability assessment to determine whether the submitted part(s) are compatible with the requested technology and capable of being produced within the desired timeline. The scope of this review includes: (i) ensuring that the file geometry is printable using the specified additive manufacturing process and material; (ii) confirming that the requested delivery date aligns with Makelab’s current production capacity; and (iii) verifying that required support structures can be generated in a manner that does not compromise essential design features or critical geometry as defined by the submitted CAD data.

Makelab is not liable for the fit, tolerance, assembly compatibility, or mechanical function of parts unless the file was created by Makelab or unless the Client has provided full assembly context and interface requirements in writing at the time of submission.

4. Acknowledged Risk Jobs

Certain projects may be classified by Makelab as “Acknowledged Risk” due to inherent complexities, urgency, or other production limitations that materially increase the likelihood of print failure, cosmetic deviation, or part inaccuracy. This designation may apply to parts with fragile or unsupported geometry, complex orientation or support requirements, long production durations, material sensitivities, or orders with expedited lead times such as same-day or next-day delivery.

Makelab will notify the Client in writing when a job is determined to be an Acknowledged Risk. Upon receipt of this notice, the Client must explicitly approve continuation of production. Approval to proceed, including submission of payment, shall constitute the Client’s acknowledgment and acceptance of the risks disclosed by Makelab.

All Acknowledged Risk orders are final sale. No refunds, reprints, or performance guarantees are offered. This policy applies specifically to, but is not limited to, all SLA Rush jobs, same-day or next-day FDM/SLA jobs, and any print job specifically flagged by Makelab as high-risk.

Where Acknowledged Risk orders are concerned, support removal may be limited to external and accessible areas only. Interior support structures may be left in place to avoid part damage. Delivery estimates for such jobs are provided as best-effort only and are not guaranteed.

Makelab disclaims all responsibility for defects, failures, or performance shortcomings related to Acknowledged Risk orders. The Client agrees to release, indemnify, and hold harmless Makelab, its agents, and its employees from any and all claims, liabilities, losses, or damages arising from or relating to such orders, whether known or unknown, direct or indirect, foreseeable or otherwise.

5. Design Services Policy

Makelab offers design services including but not limited to CAD modeling, design for additive manufacturing, and design modification. The scope of work for each design engagement shall be defined prior to project commencement and must be confirmed by the Client in writing. This includes an outline of deliverables, timeline, and cost. Makelab shall not be obligated to begin work until written approval is received and all agreed-upon payments are remitted.

Any changes requested by the Client that deviate from the originally defined scope, whether functional, aesthetic, or dimensional in nature, will be treated as new work. Makelab reserves the right to issue an updated quote, adjust timelines, and require additional payment prior to initiating such changes. Makelab shall not be held liable for manufacturing issues arising from modifications or assumptions outside the specified scope unless Makelab was expressly contracted to provide design for manufacturability across multiple processes.

Clients are entitled to one (1) complimentary design revision per project. This revision must be requested within ten (10) business days following Makelab’s final design delivery. Any additional revisions shall be subject to additional charges, billed on a per-part or hourly basis depending on complexity. Major concept changes or shifts in design intent will not be treated as revisions and require re-quotation.

Refunds for design services are not permitted once the Client has issued written approval or once Makelab proceeds with file preparation or print production. No exceptions will be granted for post-approval dissatisfaction. All design projects require written approval from the Client before production or file release.

Each design project includes one (1) complimentary PLA test print at draft resolution (300-micron layer height), material and color at Makelab’s discretion. The Client is responsible for all shipping and handling costs associated with the test print. Additional test prints or material upgrades will be treated as standalone orders and invoiced separately.

If the Client requests multiple versions, alternative file formats, variations in tolerances, or part configurations beyond the initial scope, these shall be quoted and billed as additional services. Makelab does not guarantee downstream compatibility with manufacturing methods other than the originally specified additive process unless such compatibility is explicitly contracted and agreed upon in advance.

All intellectual property developed by Makelab on behalf of the Client remains the property of the Client upon full payment, unless otherwise stated in writing. Makelab retains the right to retain anonymized versions for internal portfolio, research, or training purposes unless a written NDA prohibits such use.

6. Custom Color and Third-Party Materials

Makelab maintains a tightly controlled material inventory to ensure consistency, dimensional accuracy, and process reliability. As such, we reserve the right to reject requests for the use of third-party or customer-supplied materials.

If a Client requests a custom color, filament, or resin outside of Makelab’s standard inventory—and the request is approved by Makelab—such jobs will be produced entirely at the Client’s risk. Makelab makes no representations or warranties regarding the dimensional stability, print quality, adhesion, strength, or appearance of third-party or non-standard materials. We strongly recommend use of vetted and validated materials, such as those provided by Polymaker.

All parts printed using non-standard or Client-specified materials are considered final sale and are ineligible for refunds, reprints, or any form of quality dispute.

7. Scanning Services

Makelab provides 3D scanning services to generate digital representations (e.g., .STL or .OBJ files) of physical objects. The quality of scanned data depends heavily on the physical characteristics of the part, including size, reflectivity, surface texture, and geometric complexity.

Makelab does not guarantee dimensional accuracy, completeness, or manufacturability of any scanned file. Minor defects, voids, noise, or occlusions in the scan are considered acceptable due to current hardware limitations. Post-processing and cleanup of scanned files may be available for an additional fee and must be requested in writing.

All modifications to scanned data—such as resizing, wall-thickness adjustments, smoothing, or feature modeling—must be contracted as separate design services and are not included in the base scanning service.

Clients retain ownership of scanned data but grant Makelab a non-exclusive, royalty-free right to retain anonymized versions for internal quality control and workflow improvement. Makelab will not disclose, publish, sell, or license any identifiable scanned files without the Client’s express written consent.

Scanning services are non-refundable under any circumstances once the scan has been completed. Clients acknowledge that scanned files are for reference and preliminary design use only and are not to be relied upon for downstream manufacturing, compliance, or precise fitment without additional verification.

8. Refund and Reprint Policy

Refunds must be requested in writing within ten (10) calendar days of the delivery date. Any requests received outside this window will not be considered. Makelab shall, at its sole discretion, determine the eligibility of a refund or reprint based on the nature of the issue and supporting documentation.

In the event of a print failure caused by equipment malfunction, post-processing damage, or packaging error directly attributable to Makelab, we will reprint the part at no additional cost using the original file and specifications. If the failure results from design errors, dimensional inaccuracies, unsupported features, or insufficient wall thickness present in the Client’s submitted file, reprints will be offered at a 50% discount off the original print cost.

Orders lost or damaged in transit may be reprinted at a 50% discount if the shipment was not insured and was handled by a third-party carrier.

All refund requests in excess of $500 are subject to managerial review and may require supporting documentation, including photos and written description of the issue. Refund approvals involving large amounts will be processed within five (5) business days upon receipt of complete documentation.

Cancellations requested within two (2) hours of order confirmation may be eligible for a 50% refund. Cancellations beyond the two-hour window are considered non-refundable due to the time-sensitive nature of production scheduling and setup.

9. Bulk and Volume Order Policy

Once a bulk or volume order has been approved in writing and placed into the production queue, it is not eligible for cancellation without incurring a penalty. The following cancellation fee structure applies, based on the project stage at the time of the request:

  • If canceled prior to production start: 25% of total order value;

  • If canceled during early production (less than 25% complete): 50% of order value;

  • If canceled mid-production (25–75% complete): 75% of order value;

  • If canceled late production (more than 75% complete): 100% of order value (no refund).

Bulk production runs must proceed without interruption once initiated. Sampling, review, and approval processes are conducted prior to kickoff to mitigate risk. If the Client requests any design change, pause, or alteration in material, finish, or process once production has begun, Makelab will issue a new quote and timeline. Any work already completed is fully billable and non-refundable.

A 25% production reset fee will be applied to accommodate operational disruption if a change requires halting and restarting the production schedule. Material substitutions or redesigns will require full re-approval and revised quoting.

Bulk orders may be subject to a non-refundable pre-production fee that covers setup, sampling, scheduling, and machine time. Lead times are dependent on timely approvals, full deposit payment, and delivery of final files.

Quality acceptance for bulk orders is based on the benchmark established during sampling. Clients must document and approve all dimensional, cosmetic, and functional expectations prior to production. Makelab inspects all production units against the approved sample only; any deviations outside of those defined specifications are not guaranteed for reprint or refund.

Deviations within standard printing tolerances—unless pre-negotiated in writing—do not constitute grounds for dispute. Clients are responsible for communicating any critical dimensions, tolerance bands, cosmetic zones, and fitment requirements in writing before production begins.

10. In-Person Meetings and Facility Access

Makelab operates as a production facility and does not permit unscheduled walk-ins, drop-ins, or on-site visits under any circumstances. All client meetings, consultations, pickups, and facility tours must be scheduled in advance and confirmed in writing by a Makelab team member. Clients who arrive without prior appointment will not be accommodated.

Makelab reserves the right to limit in-person access at its sole discretion, particularly during high-volume production periods or in compliance with health, safety, or operational protocols. Clients are expected to respect these boundaries. No verbal approvals, file changes, or job confirmations delivered in person will be considered binding unless also submitted via email.

11. Restrictions on Printed Items

Makelab prohibits the submission or production of any files or objects that are intended to function as weapons or weapon-related components. This includes, but is not limited to, functional firearms, firearm frames, lower receivers, bladed weapons, explosive devices, and weapon attachments such as scopes, mounts, or rails.

Any file that contains or resembles weapon-related content will be rejected. If such content is submitted, intentionally or unintentionally, Makelab reserves the right to cancel the order without refund and, where required, report the matter to the appropriate authorities. This policy is non-negotiable and strictly enforced to ensure compliance with U.S. law and public safety regulations.

12. Limitation of Liability and Indemnification

To the fullest extent permitted under applicable law, Makelab shall not be liable to the Client or any third party for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or in connection with any service rendered, including but not limited to loss of profits, business interruption, or loss of data, even if Makelab has been advised of the possibility of such damages.

Makelab’s total cumulative liability for any claim or cause of action arising from or related to its services shall not exceed the total amount paid by the Client for the specific order giving rise to such claim.

The Client agrees to indemnify, defend, and hold harmless Makelab, its officers, employees, contractors, and affiliates from and against any and all claims, demands, losses, liabilities, costs, damages, and expenses (including reasonable attorney’s fees) arising out of or related to: (i) any use or misuse of Makelab’s services; (ii) any files or content submitted by the Client; (iii) any alleged or actual infringement of third-party intellectual property rights; or (iv) the Client’s breach of any provision of these Terms and Conditions.

13. Force Majeure

Makelab shall not be liable for any delay or failure in performance, production, or delivery arising from any event or condition beyond its reasonable control. This includes, but is not limited to, natural disasters, acts of war or terrorism, labor disputes or strikes, pandemics or public health emergencies, power outages, supply chain disruptions, manufacturing delays due to vendor issues, government restrictions, civil disturbances, or any other unforeseeable and unavoidable events (collectively referred to as “Force Majeure Events”).

In the event of a Force Majeure Event, Makelab shall be entitled to suspend or modify its performance obligations for the duration of the event without penalty or liability. If such a delay extends beyond thirty (30) days, either party may terminate the affected order upon written notice. However, the Client shall remain responsible for payment of all services rendered or costs incurred up to the effective date of suspension or termination.

14. Assembly Fit and Multi-Part Compatibility

Makelab assumes no responsibility for the fitment, mechanical interface, or dimensional alignment of parts intended for assembly unless full context is provided prior to production. This includes, but is not limited to, multi-part assemblies, interfacing components, mating surfaces, or parts that must align with third-party or externally sourced components.

If a Client requires assembled fit or dimensional coordination, it is the Client’s responsibility to disclose such requirements in writing at the time of order placement and to provide complete CAD assemblies or explicit interface specifications. Failure to disclose such requirements will result in the parts being printed and delivered as-is, based solely on the geometry of the individual files submitted.

Makelab shall not be liable for misalignments, clearance issues, or tolerance conflicts between printed components or between printed and externally manufactured parts if assembly intent was not clearly communicated in advance and approved by Makelab’s engineering team.

No refund, reprint, or warranty coverage shall apply to part compatibility issues resulting from insufficient context, incomplete information, or lack of design coordination.

15. Post-Processing Standards and Limitations

15.1 Standard Post-Processing

Unless otherwise agreed in writing, all printed parts will be post-processed using Makelab’s default internal standards. This includes manual removal of accessible supports, light cleaning to remove loose material or powder residue, and a basic quality inspection to identify obvious defects such as delamination, major warping, or structural cracking.

Makelab does not guarantee the removal of support material from internal cavities, tight channels, or fragile features if doing so would compromise part integrity. The presence of support remnants in such areas shall not be deemed a defect or grounds for reprint or refund unless explicitly addressed in the order agreement.

15.2 Premium Post-Processing

Additional post-processing services, such as surface smoothing, painting, dyeing, sanding, polishing, or fitment-specific tuning, are available upon request and must be quoted in advance. These services require written specification and client approval prior to execution. Pricing will vary based on part geometry, material, and desired outcome.

15.3 Finish Variation

Clients acknowledge that visual or tactile differences between parts—such as slight sheen variation, color inconsistencies, or minor texture differences—are natural outcomes of the additive manufacturing process and post-processing workflow. Unless a specific cosmetic requirement is defined and documented in advance, these variations are not considered defects.

15.4 Responsibility for Finish Outcome

In the absence of a written specification or reference sample, Makelab shall apply finishing techniques at its sole discretion based on internal quality guidelines. Makelab disclaims any liability for perceived deficiencies in cosmetic or tactile quality where no formal finishing criteria were submitted by the Client.

16. Intellectual Property and File Confidentiality

16.1 Ownership of Submitted Files

All CAD files, technical drawings, design documentation, and 3D scan data submitted to Makelab by the Client remain the exclusive property of the Client. Submission of such files does not transfer any intellectual property rights to Makelab.

16.2 Permitted Use

Makelab shall use Client-submitted files solely for the purposes of providing quotations, producing parts, or performing related services requested by the Client. Files may be accessed internally for engineering, quality control, or production purposes only and shall not be shared, published, sold, or disclosed to third parties without the Client’s express written consent.

16.3 No Implied License

Submission of files to Makelab does not create any implied license for Makelab to reproduce, modify, or otherwise utilize the content outside the scope of the specific service engagement. All rights not explicitly granted remain reserved by the Client.

16.4 Legal Responsibility and Indemnity

The Client represents and warrants that it holds all legal rights and authority necessary to use, transmit, and authorize Makelab to produce parts based on any submitted file. Makelab is not liable for claims of copyright infringement, trademark violation, or other legal disputes arising from unauthorized or misappropriated content.

The Client agrees to indemnify and hold harmless Makelab, its officers, employees, and agents from any and all claims, liabilities, or damages arising from the production or handling of unauthorized or infringing files, including all related legal costs and judgments.

17. File Retention and Retrieval

Makelab maintains an internal archive of production files for operational continuity, reprints, and convenience. However, we do not guarantee the availability, retrievability, or integrity of any specific file after order fulfillment is completed.

Files are typically retained indefinitely, but Makelab reserves the right to purge, archive, or delete files at any time and without notice. Clients are solely responsible for maintaining their own records and backup copies of all files submitted for production. Makelab shall not be held liable for any loss, corruption, or inaccessibility of submitted files once an order is completed and delivered.

18. Client Communication and Contact Method

All project-related communication, including approvals, change requests, confirmations, and dispute submissions, must be made in writing and sent to Makelab via email. Communications delivered via informal channels—including, but not limited to, text messages, social media, in-person conversation, or internal tools such as Slack—are considered non-binding and will not be accepted as valid instructions or approvals.

Makelab shall rely exclusively on written email records when determining project scope, approval status, and deliverable specifications. Clients are responsible for maintaining timely, accurate correspondence throughout the duration of a project. Any delays or issues arising from unclear, incomplete, or undocumented communication are the sole responsibility of the Client.

19. Shipping and Risk of Loss

Risk of loss transfers to the Client upon physical handoff of goods to the designated shipping carrier. Makelab shall not be liable for any delay, damage, or loss occurring while the goods are in transit, including but not limited to delays caused by carrier mishandling, adverse weather, customs inspections, or incomplete delivery addresses provided by the Client.

If a shipment is time-sensitive or requires additional security, the Client must request insurance or expedited shipping in writing prior to fulfillment. Insurance is not automatically included and must be confirmed and invoiced as an additional line item. Once a shipment leaves Makelab’s facility, all inquiries regarding delivery status, insurance claims, or damage resolution must be directed to the carrier.

20. Right to Refuse Orders

Makelab reserves the absolute right, at its sole discretion and without obligation to disclose reasoning, to refuse, cancel, or discontinue any order, project, or client relationship. Grounds for refusal may include—but are not limited to—technical infeasibility, violation of these Terms, unsafe or unethical applications, failure to remit payment, prior breach of agreement, abusive conduct, or submission of prohibited content.

Makelab also reserves the right to refuse services where the requested work exceeds current production capacity, presents reputational or legal risks, or conflicts with internal policies or company values. In such cases, Makelab will make reasonable efforts to notify the Client promptly and, where applicable, issue a refund for any unrendered services.

21. No Guarantee of End-Use Performance

Unless expressly contracted to provide engineering validation or regulatory certification, Makelab does not guarantee that any part produced through its services will meet the performance, durability, compliance, or safety requirements of the Client’s end-use application. It is the Client’s sole responsibility to conduct all necessary testing, validation, and certification for the intended environment or market use.

Parts manufactured by Makelab are considered prototypes or intermediate deliverables unless otherwise stated in writing. Any claim regarding part performance, fitment in field conditions, or application-specific tolerances must be supported by formal documentation and pre-approved engineering specifications. Without such documentation, all parts are delivered as-is and at the Client’s risk.

22. Modification of Terms and Conditions

Makelab reserves the right to update, modify, or amend these Terms and Conditions at any time, without prior notice. All changes shall take effect immediately upon publication on the Makelab website or upon direct issuance to Clients via email.

By continuing to engage Makelab’s services following any such updates, the Client agrees to be bound by the revised Terms and Conditions in full. Clients are encouraged to review the Terms periodically to ensure continued understanding and compliance.

Makelab’s Privacy Policy governs how data and files submitted by Clients are processed and stored. Use of our services constitutes acceptance of this policy in conjunction with these Terms.
